EPA Issues Significant New Use Rules Under TSCA for certain Chemicals

On July 28, 2020, in a Federal Register Notice (FRN), the Environmental Protection Agency (EPA) issued significant new use rules (SNURs) under the Toxic Substances Control Act (TSCA) for seven chemicals.  This would require notifying the EPA at least 90 days before beginning any manufacturing or processing for the SNUR. 

This rules affecect chemical importer that are subject to TSCA importer certification requirements.

The affected chemicals are including the following chemicals that listed under 40 CFR part 721, subpart E

  • Alkyldiamine, aminoalkyl dimethylaminoalkyl dimethyl- (generic).
  • Oxirane, 2-(chloromethyl)-, polymer with 2-methyloxirane polymer with oxirane bis(2-aminopropyl) ether.
  • Terpolymer of vinylidene fluoride, tetrafluoroethylene and 2,3,3,3-tetrafluoropropene (generic).
  • Phosphonium, tributylmethyl-, iodide (1:1).
  • Phosphorous acid, triisotridecyl ester.
  • 1,3-Butanediol, (3R)-.
  • Metal oxide-chloro (generic).

The rule will be effective on September 28, 2020.
